Terms of service

When you create an account with DesignWhiz, it is personal to you. You agree to:

• Use strong, secure passwords and enable two-factor authentication if available.
• Take all necessary precautions to maintain the confidentiality of your login information.
• Notify us immediately of any unauthorized use or security breach regarding your account.

Responsibility: You are responsible for all activity that occurs under your account. DesignWhiz may temporarily suspend your account if suspicious activity is detected for security purposes.

DesignWhiz is a space for creativity, collaboration, and growth. To ensure a respectful environment, you must not:

• Engage in hate speech, harassment, bullying, spamming, phishing, or any illegal activity.
• Post content that is false, misleading, offensive, or violates others' rights, including intellectual property rights.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines. This helps ensure a safe, creative space for everyone.

By sharing content on DesignWhiz, you retain full ownership of your work. However, you grant DesignWhiz a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content for the purpose of maintaining and enhancing the platform.

• License Termination: If you delete your content, the license will terminate. Please note that deleted content may still exist in backup storage for a limited time but will not be actively displayed or promoted.

You agree that any content you share complies with copyright laws and does not infringe on the rights of others.

Respect the intellectual property of others. You may only upload or share content that you own or have permission to share.

• DMCA Compliance: DesignWhiz complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a notice to our designated DMCA agent. We will remove the content in question and take appropriate actions as required by law.

DesignWhiz offers both free and paid subscription options. If you choose to subscribe to Pro or any other paid services:

• Subscriptions automatically renew unless you cancel before the renewal date.
• Payments are final, and no refunds will be issued, except as required by law or in cases of payment errors.

If a payment fails or your account becomes delinquent, your access to Pro features may be suspended until the issue is resolved.

While we strive to provide the best service possible, you understand and agree that you use DesignWhiz at your own risk.

• Limitation of Liability: DesignWhiz is not liable for any indirect, incidental, or consequential damages resulting from the use of the platform, except in cases of gross negligence, willful misconduct, or as otherwise required by law.
• Platform Availability: We do not guarantee that DesignWhiz will always be available or error-free, though we work hard to maintain its functionality.

You agree to indemnify and hold harmless DesignWhiz from any claims, liabilities, damages, and expenses arising out of your use of the platform or your violation of these Terms.

DesignWhiz complies with global data protection regulations, including GDPR (General Data Protection Regulation) and CCPA (California Consumer Privacy Act). For details on how we collect, use, and protect your personal data, please refer to our Privacy Policy.

• User Rights: If you are located in a jurisdiction that provides data rights (such as the right to access, delete, or correct your personal data), you may exercise those rights as described in our Privacy Policy.

We may update these terms from time to time. When we do, we'll notify you by posting the new terms on the platform and/or sending you an email.

• User Consent: Continued use of DesignWhiz following the effective date of new terms constitutes your acceptance of the changes. If you do not agree to the updated terms, you may terminate your account within 30 days of the update, and no further charges will apply.

You must be at least 13 years old to use DesignWhiz. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent to use the platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

• Arbitration: Any disputes arising from or relating to these terms will be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association (AAA). Both parties waive their rights to a trial by jury or to participate in a class-action lawsuit.
• Jurisdiction: By using DesignWhiz, you agree that any disputes not resolved by arbitration will be subject to the exclusive jurisdiction of the courts of Delaware, United States.
